Thailand's Supreme Court has ruled that Bitcoin constitutes "property" under criminal law, establishing that cases involving the cryptocurrency can be prosecuted as property crimes. The plenary session issued Judgment No. 4929/2569 following a case brought by prosecutors in Koh Samui against a defendant identified only as "Mr. A."
In the case, the victim exchanged approximately $50,000 (about 1.878 million baht) into Bitcoin and subsequently transferred it to a criminal gang. The court held that Bitcoin possesses market value, can be exchanged for cash, and is capable of being held, meaning its value equals the amount paid at the time of exchange. The ruling cited Section 137 of the Civil and Commercial Code and Sections 309 and 340 of the Criminal Code.
The judgment also referenced the Bank of Thailand's opinion, noting that while cryptocurrency is not legal tender, this designation does not preclude its recognition as property under the law.
