Thailand's Securities and Exchange Commission has launched a public consultation on draft notifications amending its derivatives business licensing framework to recognize digital assets as underlying assets under the Derivatives Act. The proposal, published October 29, covers derivatives exchanges, clearing houses, and intermediary businesses.
Under the draft rules, digital asset operators can apply for derivatives business licenses without establishing a separate company. The proposed license permits derivatives agency, proprietary trading, investment advisory, and investment management activities at a fee of 500,000 baht. Existing digital asset exchanges, brokers, and dealers are exempt from application and license fees. Only exchanges and brokers among digital asset operators may apply to operate derivatives exchanges, while custodians are barred from obtaining clearing house licenses.
The consultation period runs through November 28. This follows an earlier round of public comment on related principles conducted by the Thai SEC in April–May 2026.
