The NBA has joined major professional sports leagues in partnering with CFTC-regulated prediction market platforms, signing an information-sharing agreement with Kalshi to combat insider trading and market manipulation. The deal includes restrictions on permissible markets and explicit prohibitions on league and team personnel trading NBA event contracts.
In contrast, the NFL has refused to participate and instead filed with the U.S. Supreme Court supporting state governments' efforts to regulate prediction markets under existing gambling laws. The NFL argued that CFTC oversight is "lax and understaffed" and that platforms lack the rigorous regulatory constructs provided by state gaming authorities. Three federal court decisions have split on jurisdiction, with two favoring states.
CFTC Chairman Mike Selig called the NBA's decision "a responsible step toward protecting sports integrity and market participants from abuses in prediction markets like insider trading and fraud." Kalshi confirmed it will share integrity data, report suspicious trading, and cooperate on investigations with the league.
