The Independent Community Bankers of America (ICBA) has filed a lawsuit in federal court seeking to vacate the Office of the Comptroller of the Currency's March 2026 chartering rule. The banking trade group is also challenging a related 2021 interpretive letter that provided regulatory guidance for crypto-asset activities.
In addition to targeting the broader regulatory framework, ICBA is specifically requesting the court overturn Protego's conditional trust bank charter. The legal action represents a significant challenge to federal efforts to integrate cryptocurrency firms into the national banking system through special-purpose charters.
