U.S. financial reform advocacy group Better Markets has declared the Commodity Futures Trading Commission (CFTC) unsuitable for regulating retail crypto asset trading, arguing that its proposed framework offers weaker investor protections than SEC oversight. The group contends that unlike the Securities and Exchange Commission, the CFTC lacks a specific investor protection mandate and primarily regulates commodity and derivatives markets dominated by institutional participants.
Better Markets also questioned the legal basis for the CFTC’s expansion into retail crypto, stating that existing authorization was originally intended to combat fraud in leveraged precious metals trading rather than establish primary retail market regulation. This dispute arises as both agencies advance crypto regulatory policies under existing law following the stall of the Digital Asset Market Structure Act (CLARITY Act), with each regulator committing to continued action without new legislative authority.
