US prosecutors have objected to the introduction of cryptocurrency policy arguments in the trial of Anton and James Peraire-Bueno, accused of exploiting Ethereum using maximal extractable value (MEV) bots. In a filing with the US District Court for the Southern District of New York, prosecutors argued against an amicus curiae brief from Coin Center, suggesting it could improperly influence the jury to acquit the brothers. The Peraire-Buenos allegedly orchestrated a $25 million MEV exploit on the Ethereum blockchain in April 2023. The prosecution contends that the court should focus solely on whether the evidence supports a guilty verdict, rather than broader policy implications. Defense lawyers argue that the Coin Center brief offers valuable insights into the government's theory, which they claim could criminalize common trading strategies. The trial, which began on October 15, continues to draw significant attention from the crypto industry due to its potential impact on digital asset trading practices.
