TransparentBusiness Inc., operating as Unicoin, filed a lawsuit in the Southern District of New York against Universal Navigation Inc., operating as Uniswap Labs. The company seeks a court ruling that its UNICOIN trademark does not infringe or dilute Uniswap’s claimed UNI, UNISWAP and UNICHAIN trademarks, and asks the court to cancel the U.S. registration for the UNI trademark.
The complaint says Uniswap’s legal counsel sent three cease-and-desist letters on June 3, July 17 and August 14, alleging trademark infringement, dilution, cybersquatting and unfair competition. Uniswap demanded that Unicoin stop using UNICOIN and other UNI-formative marks, transfer the unicoin.com and unicoin.org domains, provide revenue and profit accounting, and pay Uniswap’s legal fees. Unicoin also seeks confirmation that the domains do not violate the federal Anti-Cybersquatting Consumer Protection Act.
