Investors of the defunct crypto brokerage Voyager Digital have filed an appeal with the Eleventh Circuit Court of Appeals, challenging the dismissal of their lawsuit against Mark Cuban and the Dallas Mavericks. The appeal contests a Florida federal judge's decision, which ruled that the investors failed to establish sufficient connections between Cuban and the state of Florida. This follows a previous denial of a motion for reconsideration by the same judge.
The lawsuit, initiated in 2022, accuses Cuban and other celebrity promoters of endorsing unregistered securities prior to Voyager's collapse. While other defendants, including Rob Gronkowski and Victor Oladipo, settled for $2.4 million in 2024, Cuban and the Mavericks remain the sole defendants. Voyager filed for bankruptcy in July 2022 after a bank run and a significant loan default by Three Arrows Capital.
