A U.S. federal judge in California has dismissed a class-action lawsuit against several celebrities, including Justin Bieber, Paris Hilton, and Steph Curry, who were accused of promoting Bored Ape Yacht Club (BAYC) and ApeCoin NFTs. The plaintiffs, Adonis Real and Adam Titcher, alleged that Yuga Labs colluded with these celebrities to artificially inflate the value of the tokens by gifting them NFTs and paying for promotional activities.
The court ruled that the plaintiffs failed to demonstrate that BAYC and ApeCoin qualify as securities under the Howey test, a key legal standard for determining securities. Additionally, the judge referenced a recent SEC statement indicating that meme coins are not considered securities. The plaintiffs have been given until October 10 to file a third amended complaint.
