The NFL argues that sports contracts offered by prediction markets constitute gambling rather than swaps and should fall under state regulation instead of exclusive CFTC jurisdiction.
The league highlighted that nearly $2 billion of the $3.3 billion in prediction market trading volume on the first Sunday of this season was tied to NFL events. Kalshi countered that federal regulation through the CFTC provides more uniform oversight than individual state frameworks and noted the agency already regulates sports-related markets.
