China's National Development and Reform Commission (NDRC) has released the new "Measures for the Administration of Outbound Investment," a 76-article regulation spanning six chapters covering general provisions, guidance and services, supervision, protection, legal liability, and supplementary provisions. The rules take effect on December 1, 2026, simultaneously repealing the 2017 "Measures for the Administration of Overseas Investment by Enterprises." The Measures establish that investors enjoy autonomy in outbound investment activities under market-oriented principles, making independent decisions while bearing risks and profits on their own. The framework aims to better safeguard the development and security of outbound investment at the institutional level and supports active participation in international cooperation and competition.
