A New York federal court has declared a mistrial in the case against brothers Anton and James Peraire-Bueno, after the jury failed to reach a unanimous verdict. The brothers were accused of involvement in a 2023 Ethereum on-chain MEV attack that netted approximately $25 million in about 12 seconds. Prosecutors alleged the operation was a "bait and switch" scheme involving fraud and money laundering. The defense argued that the transactions were akin to on-chain "front-running" strategies. After three weeks of trial, the jury's inability to agree led to the mistrial declaration.
