Coinbase is calling on the U.S. Department of Justice to intervene in state-level regulatory actions against cryptocurrency companies. In a 14-page letter, Chief Legal Officer Paul Grewal urged the DOJ to push Congress for broad preemption provisions to prevent states from enforcing regulations on federally regulated digital assets. Grewal highlighted Oregon's lawsuit against Coinbase as an example of government overreach, arguing that it reflects misconduct rather than federalism. Grewal also proposed that the DOJ issue an opinion letter to clarify that federally regulated digital assets should not be subject to state blue sky laws. He suggested that new state licensing and regulatory requirements should not apply to cryptocurrency intermediaries and that these clarifications should be retroactive. This move comes as states attempt to fill regulatory gaps left by federal oversight changes under the current administration.
