Prosecutors in the Tornado Cash case have admitted to a mistake in attributing a Telegram message to the development team, which was used to suggest guilty consciousness. The message, asking how to cash out $600 million, was actually written by a CoinDesk reporter and forwarded by Alexey Pertsev. The Southern District of the United States acknowledged the error, noting that the original chat records lacked a forward label, but stated that a corrected version was provided in December 2024. Roman Storm's defense team has requested the exclusion of all Telegram evidence from Pertsev's mobile phone, citing concerns over the integrity of the grand jury process. Pertsev has already been sentenced to 64 months in prison by a Dutch court for his role in money laundering activities.
